En 2012, la Administración de Obama emitió una orden ejecutiva que hoy se conoce como DACA o Acción Diferida para los Llegados en la Infancia. Esta ley permite que los niños que llegaron a los Estados Unidos ilegalmente puedan permanecer en el país. La razón de esta ley fue evitar la deportación de niños que ya se habían asimilado en la cultura estadounidense.

DACA permite que los niños que fueron traídos ilegalmente puedan continuar residiendo en los Estados Unidos si cumplen con los siguientes requisitos.

Elegibilidad de DACA:

Eran menores de 31 años al 15 de junio de 2012;
Ve a los Estados Unidos antes de cumplir 16 años;
Ha residido continuamente en los Estados Unidos desde el 15 de junio de 2007 hasta la actualidad;
Estaban físicamente presentes en los Estados Unidos el 15 de junio de 2012, y al momento de hacer su solicitud de consideración de acción diferida con USCIS;
No tenía estatus legal el 15 de junio de 2012;
Actualmente está en la escuela, se graduó u obtuvo un certificado de finalización de la escuela secundaria, obtuvo un certificado de desarrollo de educación general (GED) o es un veterano licenciado honorablemente por la Guardia Costera o las Fuerzas Armadas de los Estados Unidos; y
No han sido condenados por un delito grave, delito menor significativo, o tres o más delitos menores, y no representan una amenaza para la seguridad nacional o la seguridad pública.

Si cumple con el requisito, ahora puede solicitarlo con USCIS y recibir el estado de DACA. Con DACA ahora puede obtener un Permiso Legal de Trabajo y puede solicitar una Tarjeta de Seguro Social. Sin embargo, el estado de DACA no es para siempre, el destinatario debe renovar su estado y permiso de trabajo cada dos años.
